Terms of service

These terms are an agreement between you and Garm Tech B.V., registered in the Netherlands under Chamber of Commerce number 99602075 with VAT number NL869056748B01, at Staalkade 6 O, 1011 JN Amsterdam, the Netherlands ("Garm Tech", "we", "us"). They apply when you install the evalship GitHub App, sign in at evalship.com or use any part of the service. If you don't agree, don't use evalship.

If you accept these terms for an organization, such as by installing the App on its GitHub account, you confirm that you may bind that organization, and "you" means the organization.

The service

evalship reads eval results that your GitHub Actions workflows upload as artifacts, and posts a comment, a check and badges for your pull requests. Your coding agent writes the audit of your evals during setup. evalship doesn't run your evals or hold your API keys. What it reads, stores and sends to a model is described in Data and privacy.

Accounts and access

You sign in with GitHub or with a link sent by email. Keep access to your GitHub account and email secure: you're responsible for what happens under your account.

Account owners decide who is invited to their account and can remove people at any time. Invited people can read every repository in the account.

Plans and billing

Plans, prices, plan limits, how users are counted and the launch offer are described in Pricing and billing and on the pricing page. They are part of these terms.

Paid plans are sold through Polar, our merchant of record. Polar charges your card, handles VAT and sales tax, and issues invoices, under Polar's own terms. By subscribing, you authorize recurring charges at the price and frequency shown at checkout. Seats follow your active users, and Polar prorates every change.

Team and Pro start with a 7-day trial, once per customer. You can cancel at any time in the billing portal. Cancellation takes effect at the end of the billing period; there are no refunds for the rest of a period you've paid for. Your account then goes back to Free and nothing is deleted.

Right of withdrawal. If you are a consumer in the European Union, you may withdraw from a subscription within 14 days of the purchase without giving a reason. Email [email protected] within those 14 days and we refund the amount paid for that billing period. This doesn't apply to renewals.

Your content

Your code, eval results, audits and settings stay yours. You give us permission to process them as far as needed to run evalship: to store them, show them to people with access, post comments and checks to GitHub, and send the parts listed in Data and privacy to a model.

Reports for public repositories are public unless you turn the public report off in the repository's settings. Reports for private repositories are only shown to people with access.

Keep secrets and personal data out of eval inputs, outputs and failure messages: evalship stores them as your eval run writes them. Where eval results do contain personal data, you are the controller and we process it on your behalf. If you need a data processing agreement, email [email protected].

Acceptable use

Don't:

  • use evalship to break the law or someone else's rights;
  • try to read data from accounts or repositories you don't have access to;
  • get around plan limits, user counting or the trial;
  • put unreasonable load on the service, or scrape it;
  • resell evalship or access to it without our written permission;
  • use it in a way that breaks GitHub's terms.

What evalship does and doesn't promise

evalship helps you review changes; it doesn't decide what you merge. Every number in a report is computed by code, but notes in a pull request comment are written in part by a model and can be wrong. evalship can miss regressions, untested changes or problems in your evals, and a passing check doesn't mean a change is safe.

The service is provided "as is" and "as available". We don't promise it will be uninterrupted or free of errors, or that it will catch any particular problem.

Third-party services

evalship depends on GitHub, Polar, OpenRouter and the other providers listed in Data and privacy. Your use of GitHub is governed by GitHub's terms. We're not responsible for those services.

Liability

To the fullest extent the law allows, Garm Tech isn't liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost data or interruptions, even if we were told they were possible. Our total liability for any claim is limited to what you paid us in the 12 months before the claim.

Nothing in these terms limits liability that can't be limited by law, including consumers' mandatory rights.

Intellectual property

evalship, its software, name and logo belong to Garm Tech. These terms give you the right to use the service, nothing more. If you send us feedback, we may use it without owing you anything.

Ending the service

You can stop at any time by uninstalling the GitHub App. What happens to your data then is described in Retention.

We may suspend or end your access if you break these terms. If we end your access for another reason, or stop offering evalship, we refund the unused part of the current billing period.

Changes to these terms

We may update these terms. For material changes, we email account owners at least 14 days before they take effect. Other changes are shown by the date at the top. If you keep using evalship after a change takes effect, you accept the new terms.

Law and disputes

These terms are governed by Dutch law. Disputes go to the courts of Amsterdam, the Netherlands. If you're a consumer in the European Union, this doesn't take away the mandatory rights you have under the consumer protection law of your country.

If a court finds part of these terms invalid, that part is changed as little as needed to make it valid, or removed, and the rest still applies.
